Senate Bill (SB 664): Effective January 1, 2021, requires public employers, contractors, and subcontractors to use E-Verify to verify employment eligibility. While private employers are not required to utilize the E-Verify system under this law, for those who choose not to use E-Verify, private employers are now required to retain the documentation used to complete the form I-9, which is presently optional under federal law.
